FREE TOUR

1.- Free Tours are intended for the enjoyment of individual travelers or small groups of up to 8 people. The tours are operated on a tips-only basis, meaning that the client sets the price at the end of the visit, and there is no upfront cost to access the tour. Whilst it is not necessary for individual travelers to prebook, we strongly advise doing so. If you have not booked, we recommend that you arrive at least 10 minutes before the tour starts, to secure your place, as there are limited spots available. Spots on the tour are allocated first to reservations, and in the absence of reservations, on a first-come first-served basis.  Individuals presenting themselves at the start point are not subject to any charge. However, we do require that you do so no later than 10 minutes before the start of the tour, after which point we reserve the right to allocate your place to somebody else. This is in the interests of fairness to all those wishing to participate on the tour, as well as to ensure their punctual start.

2.- As a general rule, if there are less than 5 people in a specific language, the tour can be canceled. It’s a quite unusual situation, that currently occurs in less than 2% of the tours that runs all year long, confirming it on the time and date the tour should begin. In addition, you will find  tourist’s information points all around the city, and our guides will be happy to give you advice about where to go, what to do and will answer all your questions. Should you not be able to attend your tour, and need to cancel your booking, please let us know at info@exploramalaga.com

3.- For quality and management reason, we do not accept more than 8 people per reservation. If you are a group of more than 8 people, you should therefore book for the appropriate private tour. You will find all the private tours information on our website, being all of them personalized, flexible and adapted to the group who request it and their needs and interests (start time, duration, etc.). PRIVATE TOURS

1.- Groups of eight or more persons should book a private guided tour. Our Free Tours are intended for small groups and individuals. You can check all the information on our website. Please contact us for further questions about creating your own tour.

2.- Private tours must be paid. Your booking confirmation and invoice will be automatically send as soon as the tour date has passed.  If you do not receive them for any reason, please contact us, because that might mean your booking has not been succesfully reserved. Check your spam folder before calling. Your reservation include guide service, transport or food when indicated so. Which is not specified, is not included.

3.- OUR RESPONSIBILITY. When a tour is canceled, and it’s Explora Málaga SL responsibility or one of the tour guides we work with, we will refund a 100% of the purchase price and will offer up to 100% of the tour’s value as credit for another tour as compensation. 

4.- YOUR REQUEST. If you are unable to attend the tour and need to cancel a reservation you inform us, at least:

  • 7 days before the tour, we will refund 100% of the purchase price.
  • 48 before the tour, we will refund 50% of the purchase price.
  • There won’t be a refund if the notification is given within 48 hours prior to the tour date.

5.- TICKETS. Just in case that your reservation includes tickets to monuments and/or museums, their amounts won’t be refundable.

6.- FORCE MAJEURE. We won’t be responsible if we are unable to offer a tour due to force majeure (pandemics, tsunamis, earthquakes, volcanic dust clouds, extreme weather, etc.). In these cases, the reservation will be treated exceptionally, trying to move it to another date/time or cancel it with a full or partial refund depending on the circumstances.

7.- The BOOKING of the requested tour will be formalized only with the payment in advance of 100% of the total budgeted amount before the date of completion, this being the only way to ensure availability, and therefore, block the day according to the agreed terms. If this wasn’t the case, Explora Málaga SL reserves the right to automatically cancel after 3 days of having informed the client and the client has not responded.


PARTICIPATION

PARTICIPATION IS VOLUNTARY. Participation in a Explora Málaga SL tour is strictly voluntary and both your guide and Explora Málaga SL reserve the right to deny participation to anybody for any reason at any time. As in all human endeavors, there is a level of risk. We do our best to keep the risk to a minimum. Explora Málaga SL, its contractors, parent and subsidiary companies, partners and employees assume no liability or responsibility for any injury, loss, damage or inconvenience sustained by any person using its services, nor to their property.

CONSENT

The client confirms that has been informed in detail and all doubts expressed to Explora Málaga SL have been resolved, and therefore, accepts the suggested proposal and declares that agrees with what was contracted, exempting Explora Málaga SL from any responsibility or expectations beyond of what was agreed. Furthermore, Explora Málaga SL undertakes with the client to execute the proposed service in time, structure and manner, except in force majeure cases. Any delay respecting the agreed starting time could entail modification in both the length and the planned itinerary.

PRIVACY

Explora Málaga SL does not sell your personal information to other companies. We reserve the right to use your data for marketing campaigns and operational reasons.

ADVERTISING

ADVERTISING USE. Whenever we request your personal data, we will clearly inform you what personal data we collect and for what purpose. In general, we collect and process your personal data for providing information, promotions, special projects, services, products, relevant information and news of our industry, and sending regular newsletters.

CONFIDENTIALITY

Regarding data protection and confidentiality, in the event that the provision of the services involves the need to access personal data, the supplier, as data processor, is obliged to comply with LO 3/2018, of December 5th, on the Protection of Personal Data and Guarantee of Digital Rights and Royal Decree 1720/2007, of December 21th, which approves the Regulations for the development of Organic Law 15/1999 and other applicable regulations. The supplier will be liable, therefore, for any infractions that it may incur in the event that it uses personal data for another purpose, communicates it to a third party, or in general, uses it irregularly, as well as when it does not adopt the necessary measures. corresponding for the storage and custody of the same. To this end, it is obliged to indemnify the client for any damages suffered directly, or for any claim, action or procedure, which is caused by a breach or defective compliance by the supplier of the provisions of both the Contract as provided in the regulations governing the protection of personal data.

For the purposes of LO 3/2018, of December 5th, on the Protection of Personal Data and Guarantee of Digital Rights, the supplier will only process the personal data to which it has access in accordance with the client’s instructions and will not apply them. or use them for a purpose other than the purpose of the contract, nor will they communicate them, not even for their conservation, to other people. In the event that the supplier uses the data for another purpose, communicates it or uses it in breach of the stipulations of the contract, it will also be considered responsible for the processing, and will be liable for any infractions incurred personally.

The supplier must adopt the necessary technical and organizational measures to guarantee the security of personal data and prevent its alteration, loss, processing or unauthorized access, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed, whether they come from human action or from the physical or natural environment. For these purposes, the supplier must apply the security levels established in Royal Decree 1720/2007 according to the nature of the data it processes.
